CHENNAI: The Madras High Court on Tuesday confirmed the death sentence imposed by a trial court at Chengalpattu here in February this year on 23-year-old S. Daswanth for having raped and murdered a seven-year-old girl at Mugalivakkam near here last February.

A Division Bench of Justices S. Vimala and S. Ramathilagam dismissed a criminal appeal preferred by the convict and held that a Mahila Court in Chengelpattu was perfectly right in having imposed capital punishment for the gruesome offence committed by the appellant.

The victim was the convict’s neighbour at an apartment in Mugalivakkam. He was found guilty of having raped the child when her parents were away and then murdered her.

According to the prosecution, he hid the body in his house for a day before taking it out in a travel bag and dumping it under a bridge near Anakaputhur. The next day, he went back to the spot and burnt the body. Further, he enacted a drama by alerting the police control room after posing as a passerby who happened to chance upon the body.

Days before the trial in the rape-cum-murder case was to begin in December 2017, the appellant, on bail then, reportedly murdered his mother Sarala in Kundrathur and fled to Mumbai.

The police nabbed him after a long search and brought him back to Chennai to face trial in both the cases.

In its judgement, the trial court had said: “All his (convict) acts are barbaric, inhuman and unkind... If there is any leniency shown to him, that will make people lose faith in the justice delivery system and the Indian judiciary. Hence he should be given severe punishment.”
